Seasoned lotto player Rich Zelasko finally bagged what every lottery dreams about; a multi-million dollar jackpot. Unfortunately for him, his ex-wife felt that she was entitled to her share of the jackpot, so she headed to a divorce court to put in her claim.
Mary Zelasko's lawyer argued in court that because the two had always shared in the losses, they deserved to now share in the winnings. The couple had been married for seven years, and filed for divorce in 2011 but it wasn't until 2018 that the divorce was finalised.
Rich's lawyer argued that it had been his luck, and not hers, that was responsible for the win and should therefore be entitled to the entire sum. After all deductions and taxes had been paid the jackpot came to $38, 873,000.
Rich had bought the winning ticket in 2013 the couple were already separated, but not yet divorced. Their divorce proceedings were under way while their lawyers worked out the details of the split such as child support and custody.
When considering his decision the judge took into account that Rich had not paid child support in years and that while the couple were married Mary had roughly three times as much money as Rich had.
Rich has already has appealed the decision, but as it stands his ex-wife is looking to claim a multi-million dollar lottery jackpot without even having to buy a ticket!
